What is a Trust
A Trust is a creation by a party or parties who set up and define the financial and practical objectives of the Trust. The Trust Managers then manage the specified Trust strictly according to the objectives and directives outlined in the Trust document.

How does TMS Inc invest Trust Funds?
TMS Inc invests trust assets only in No Load Mutual Funds and existing real estate. This may be funded into the Trust at its inception itself. TMS Inc does not receive any fee from funds that it invests in. The particulars regarding the methods and the funds we invest in, is clearly elucidated to the Grantor of any Trust. We also specify exactly what the Trust needs would be. In case we do not receive any directives from a Grantor, we would routinely invest the assets into a Balanced Fund holding both Stocks and Bonds.

Dispute Settlement
TMS Inc. uptil now never been involved in litigation. For the convenience of settling any dispute that may unforeseeably arise, our contract calls for dispute resolution by a mutually acceptable person who is specifically not an attorney. One will not be required to travel across the U.S. to settle any dispute. Dispute settlement may be carried out via mail and/or over the phone. TMS Inc. charges an annual fee of 1% of the assets being managed. This needs to be paid every quarter. In the event of the Grantor's or the Beneficiaries' desire to terminate their contract with TMS Inc., we would facilitate that as expeditiously as possible.We are happy to state that, until now, such a termination has not occurred.

DEMYSTIFYING THE 'TRUST'

A Trust is a legal instrument which enables you to grant authority to another person or company to manage your specified assets, who also would be responsible for distributing of income(s) to the beneficiaries named by you in the Trust, including yourself. The Grantor of a Trust is the person who funds the Trust. The Grantor dictates the terms & conditions which would govern the specific Trust: viz., who gets what and when. The reasons for establishing a Trust are many. The primary reasons could possibly be:

1. To provide income for a person who may not be able to invest and spend money wisely.
2. To avoid probate expenses
3. To reduce estate taxes
4. To provide for offspring and other dependents if you should remarry or predecease your spouse.
5. To protect family assets from creditors.

The two main types of Trust are the Revocable Trust and the Irrevocable Trust. The most popular at this time is the Revocable Trust wherein a Grantor may modify the terms of the Trust at any time. This is also called the Living Trust. A type of Trust that is rapidly gaining popularity nowadays is the Perpetual Trust or  Dynasty Trust in which the Trust can continue indefinitely, spanning even many generations.
